However, in 2016, the FDA expanded this tobacco product definition to include e-cigarettes, cigars, pipes, and water pipes. Although the FDA vaguely defines “tobacco products,” it is not clear if they included products free of nicotine or tobacco in this definition.

The government classified CBD as a drug under the Food, Drug, and Cosmetic Act (FDCA), which defines a drug as “a product intended for the diagnosis, cure, mitigation, treatment, or prevention of disease.”

Therefore, FDA treats any CBD-infused product, plus smokables, as a drug. Drugs have tight regulations and undergo approval pre-market. Currently, The FDA only approved Epidiolex, a CBD-infused pharmaceutical drug, to treat epilepsy.

Distributors would require submitting the product for pre-market approval before putting it up for sale to make CBD smokables FDA-approved. No distributor will comply with current FDA rules until the agency issues clear guidelines for CBD smokables.

The global legal status of CBD hemp flowers varies. For instance, Switzerland permits products with less than 1% tetrahydrocannabinol (THC). In addition, some Swiss supermarket chains publicly sell CBD cigarettes.
